Federal Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without legal authority.
"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.
The situation stems from a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. After his return to the United States to answer alien smuggling charges, he was detained in federal detention.
In her decision, the judge pointed out that the authorities does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
